ASX Company News: Genetic Technologies Licence Patents

Genetic Technologies (GTG) is pleased to report that it has now executed a Settlement and License Agreement with ViennaLab Diagnostics GmbH of Vienna, Austria. Under the agreement, ViennaLab is granted non-exclusive rights to a number of GTG patents related to its non-coding DNA technology.

Genetic Technologies was an early pioneer in recognizing important new applications for “non-coding” DNA. The company has since been granted patents in 24 nations around the world, securing intellectual property rights for specific uses of non –coding DNA in genetic analysis and gene mapping across all genes in all species. Its business strategy is the global commercialization of its patents through an active out-licensing program and the global expansion of its oncology and cancer management diagnostics portfolio.

ASX Company News: Genetic Technologies Signs Licence Agreement With Monsanto

Genetic Technologies Limited (GTG) is pleased to announce that it has granted a third license to Monsanto Company of St. Louis, Missouri, USA (“Monsanto”).  Genetic Technologies had previously granted a non-exclusive license to the GTG non-coding patents to Monsanto in 2007 for all applications in plants and plant products. Soon after, GTG also granted Monsanto a further non-exclusive license for applications in swine. The current license now grants Monsanto similar rights for cattle. The commercial terms of this further license are covered by formal confidentiality provisions within the relevant Settlement and License Agreement and therefore cannot be disclosed.

This new license follows recent discussions with Monsanto, further to the patent infringement law suit filed by Genetic Technologies in the Western District of Wisconsin earlier this year.  Genetic Technologies is also now engaged in discussions with other parties pertaining to this law suit and further details will be released to the Market as additional license agreements are duly executed. Genetic Technologies is also engaged in a number of licensing negotiations separate to this law suit and details of relevant outcomes from these additional activities will similarly be released to the Market, as appropriate.

Genetic Technologies was an early pioneer in recognising important new applications for “non-coding” DNA (Deoxyribonucleic Acid). The Company has since been granted patents in 24 countries around the world, securing intellectual property rights for particular uses of non-coding DNA in genetic analysis and gene mapping across all genes in all species. Its three-pronged business strategy includes: 1) the global commercialisation of its patents through an active licensing program; 2) the expansion of its dominant commercial genetic testing business with a focus on oncology and cancer management including BREVAGen™, the Company’s first in class test for non-hereditary breast cancer risk; and, 3) the commercialisation of its various research and development projects aimed at generating further  intellectual property of potentially global commercial significance.

Genetic Technologies Settles Licence Agreement

Genetic Technologies Limited (GTG) has executed a Settlement and License Agreement with respect to its non-coding patents with EraGen Biosciences Inc. (“EraGen”), based in Madison, Wisconsin, USA. This is the second such agreement that GTG has secured in the last week.  The license granted by GTG covers the activities of EraGen in relation to its genetic diagnostic and analysis products, limited to USA and Canada. The commercial terms of the license granted to EraGen are subject to confidentiality between the parties.

Although not a counterparty to GTG’s US patent infringement suit (ASX announcement 16 February 2010), discussions between GTG and EraGen regarding GTG’s non-coding patents have been proceeding for some time, and have now resulted in GTG granting to EraGen a non-exclusive license for all EraGen products, as well as the normalisation of past historical sales by EraGen.  Discussions with other parties both in the context of the patent infringement suit and external to that suit are ongoing and progressing. Further details will be released to the market when appropriate.

Genetic Technologies Signs Distribution Agreement

Genetic Technologies Limited (GTG) is pleased to advise that it has executed an Exclusive Test Distribution and Services Agreement with Response Genetics, Inc., under which Genetic Technologies will become the exclusive distributor in Australia, Indonesia, Malaysia, the Philippines, Singapore and Thailand for Response Genetics’ ResponseDX: ColonTM, ResponseDX: LungTM and ResponseDX: GastricTM genetic test panels, proprietary PCR-based molecular diagnostic tests for cancer.

“ResponseDXTM tests offer physicians and their patients an objective way to chart a course of therapy during a very stressful time – the period between diagnosis and the start of treatment,” said Ms.  Kathleen Danenberg, CEO and president of Response Genetics. “Based on encouraging sales and rapid adoption in the United States, we are pleased to partner with Genetic Technologies to make our ResponseDXTM tests available in Australia as well as in certain Asian countries.” Dr. Paul MacLeman, CEO of Genetic Technologies said “This is an important further step in Genetic Technologies’ move into advanced cancer management. As previously announced, we are seeking to leverage in-house developed tests through partnerships with third party developers of novel tests. This agreement, which follows similar distribution arrangements with Rosetta Genomics, Inc. and Trimgen, Inc., will assist us to expand our growing portfolio of genetic tools that will enable oncologists to more effectively manage patient diagnosis and therapy, improving treatment outcomes.
